California: Proposition 90
Proposition 90 Supporters File New Ballot Initiative for 2008
Supporters of the recently defeated eminent domain and regulatory takings measure have filed a new initiative with the state Attorney General. The new initiative is slightly rewritten but remains essentially unchanged in its purpose and impact. The attorney general’s office will review the initiative and, if approved, issue a ballot title and signature gathering can begin. Supporters are looking to place the new measure on the 2008 ballot.

Proposition 90 Defeated
Voters in California rejected Proposition 90. The measure combined eminent domain and regulatory takings provisions. The sweeping measure would have jeopardized a wide array of local protections and threaten to impose steep costs on taxpayers. Prop 90 was successfully opposed by a broad coalition of organizations including business groups, planners, environmentalists, local governments, organized labor, farm groups, public employees, first responders, and many others. The coalition against Prop 90 has focused on the enormous potential costs calling it "a taxpayer trap." The measure was opposed by virtually every major newspaper in the state. Governor Schwarzenegger also came out in opposition to Proposition 90.
