Nevada Takings & Eminent Domain Initiative Violates "Single Subject" Rule
A takings ballot measure qualified in Nevada as a proposed amendment to the state constitution. The amendment contained both eminent domain prohibitions and a regulatory takings provision. The measure is known as the People's Initiative to Stop the Taking of Our Land (PISTOL). The measure was challenged in court by a broad coalition of organizations on the grounds that the combination of eminent domain and regulatory takings violated the state's "single subject" rule for ballot measures. The Nevada Supreme Court agreed that PISTOL violated the rule and struck down the provisions related to regulatory takings. The eminent domain provisions remained on the ballot and were approved by the voters. In Nevada, constitutional initiatives must be passed by voters in two successive elections.
